Wishplace – Credits Policy
This Credits Policy ("Policy") explains the acquisition, management, and usage of digital credits ("Credits") within the Wishplace platform (the "Platform"). This Policy forms an integral part of the Wishplace Terms and Conditions.
1. Purpose of This Policy
Wishplace uses a credit-based system to facilitate specific technical operations within its digital venue. These Credits serve as the internal unit required for users to publish real estate requirements, list properties, or initiate contact with other users via the Platform’s matching environment.
2. Legal Status & Right of Withdrawal
Credits are digital consumable units purchased exclusively through the Platform. They have no cash value and are generally non-refundable after lawful consumption, subject always to mandatory consumer law and the applicable store process.
EU consumer rights: Nothing in this Policy waives a statutory withdrawal, refund or conformity right. Where the law permits loss of a withdrawal right for digital content or a digital service supplied immediately, that loss applies only if the legally required prior express consent, acknowledgement and confirmation have been obtained. Otherwise, mandatory rights remain unaffected.
By purchasing or using Credits, you acknowledge that:
- They have no monetary value and are not legal tender.
- They are not transferable between accounts or users.
- They cannot be exchanged for cash or real-world currency.
- They represent a limited, non-exclusive, revocable license to access specific technical functions within Wishplace.
3. Acquisition of Credits
Credits can only be obtained through authorized channels:
- In-App Purchases: Handled exclusively via the Apple App Store (iOS) or Google Play Store (Android).
- Payment Processing: Wishplace does not process payments directly. All billing, currency conversion, and payment security are managed by the respective App Store providers.
- Promotional Credits: Wishplace may, at its sole discretion, award "Bonus" credits. These carry the same restrictions as purchased credits.
4. Usage and Consumption
Credits are "consumed" when used to perform specific operations. Current enabled operations include:
- Adding a "Wish Place": Publishing specific real estate requirements to the matching algorithm.
- Adding a "Property": Listing a property for rent or sale.
- Contacting a User: Initiating a direct communication channel (chat) with a matched party.
The required number of Credits for any action will be clearly displayed before you confirm the operation. Wishplace reserves the right to introduce new technical operations or modify the credit requirements for existing ones at any time.
5. The Confirmation Window & Reimbursement
In accordance with Section 10 of the Terms and Conditions, specific operations may feature a temporary "confirmation window."
- In-App reversal: Where the App offers a Delete or cancellation option, the confirmation screen explains whether Credits are returned.
- After the window: Once the window closes, Credits are considered consumed for the App's internal reversal feature. This does not limit mandatory consumer rights or an applicable store refund process.
6. Management and Security
- Infrastructure: Credit balances are stored and managed via secure PostgreSQL databases hosted on Google Cloud infrastructure.
- Authentication: Your credit balance is strictly tied to your unique User Identifier (UID) provided by the authentication system (e.g., Apple, Google, or Email login). If you lose access to your provider account, Wishplace may be unable to recover your balance.
7. Refunds and Forfeiture
- Used Credits: Generally non-refundable once the relevant digital feature has been supplied, except where mandatory law or the applicable store process provides otherwise.
- Unused Credits: Generally non-refundable, subject to mandatory law. Transactions are processed through Apple App Store or Google Play. Consequently:
- Wishplace does not have the technical capacity to issue monetary refunds directly.
- Refund requests should normally be submitted through the relevant Store process. Nothing here removes any claim or remedy that must legally be available against the Operator.
- Account Deletion: If you delete your account, remaining Credits cannot be used and are generally forfeited, subject to mandatory consumer law and any applicable store remedy.
- Conformity remedies: Consumers retain mandatory remedies for a failure to supply or lack of conformity of the digital content or service, including restoration, proportionate price reduction, termination and reimbursement where applicable.
8. Investigation of Issues & Limitation of Liability
In the event of technical discrepancies, failed operations, or disputes regarding Credit balances:
- Best Efforts Investigation: Wishplace will, upon receipt of a documented report, make reasonable efforts to investigate the issue and clarify the status of the technical operation or ledger entry.
- Third-party issues: The Operator is not responsible for a third-party failure to the extent the law permits and the failure is outside the Operator's control. This clause does not exclude liability or consumer remedies that cannot legally be excluded.
9. Account Integrity & Illegal Acquisition
Wishplace reserves the right to suspend access or reset credit balances without compensation in cases of:
- Fraud or Chargebacks: Reversed payments result in immediate removal of Credits and potential account suspension.
- Illegal Acquisition: Hacking, exploiting software vulnerabilities, or unauthorized manipulation of the Credit system will result in immediate termination of the account and potential legal action.
- Platform Abuse: Attempts to "farm" or manipulate the system.
10. Governing Law
This Policy is governed by the laws of Spain, without prejudice to mandatory protection under the law of a consumer's country of habitual residence. Consumers may bring claims before any court having jurisdiction under mandatory law. For non-consumer disputes, the courts of Spain have jurisdiction unless mandatory law provides otherwise. If a translation differs from the English version, English is the reference version except where mandatory law requires otherwise.
